Overview of position

Addressing the issue of missing persons at a national level and uncovering the truth about the fate of themissing through a fair, transparent, and scientific truth-seeking process is of paramount importance fornational reconciliation, and the legacy of persons missing runs deep in Libya, both before and after therevolution. While the Transitional Justice (TJ) process is still not fully installed, thousands of families, until now, do not know what happened to their loved ones. Families of the missing, civil society actors, and humanrights defenders advocating for truth and justice often face intimidation and reprisals, while accountabilitymechanisms remain weak. In Libya, a clear legal framework in line with international standards to address

missing persons or install TJ mechanisms at the national level still needs to be implemented. Inclusive advocacy and capacity building are required to search for all missing persons, considering their families' social, psychological, financial, and legal needs.

The project “Addressing the issue of missing persons through supporting meaningful victim participation and building responsive justice and security sector institutions” (hereafter: “Missing Persons project”),implemented in partnership between UNSMIL and UNDP and funded by the Netherlands' Ministry of Foreign Affairs, was developed based on a preliminary situation analysis and needs assessment to better understand the needs, concerns, and initiatives of both communities and local partners.

Consultations held by UNSMIL and UNDP under their joint project revealed a widespread lack of awareness of rights, entitlements, and available services among families, as well as limited access to trusted legalassistance. Women, in particular, are disproportionately affected due to socio-economic vulnerability and

the absence of effective witness and victim protection laws in Libya. The absence of competent, trusted legal professionals constitutes a significant barrier to families’ participation in ongoing or future judicial and transitional justice processes. Legal professionals, who could play a key role in assisting families to navigate administrative and judicial systems, remain undertrained and under-resourced. Many are unfamiliar with relevant international norms and domestic procedures related to missing persons, including those governing declarations of absence, inheritance rights, and compensation claims for families The project aims to strengthen the legal aid ecosystem by enhancing the capacity of Libyan lawyers and civilsociety organizations to support families in accessing justice mechanisms, while fostering coordination between justice, forensic, and victim-support institutions. Within this framework, the project will alsosupport the design of a structured referral system connecting families with trained lawyers through a standardized operating procedure (SOP), ensuring clarity of roles, coordination mechanisms, and accountability.At the same time, the security environment and the sensitive nature of these cases discourage lawyers from taking on such matters, as lawyers themselves are at risk of being disappeared, threatened, or arrested. This leaves families - particularly women - without legal representation to seek redress, and a general lack of trustin the judicial system. Without building the capacity and protection of legal professionals, efforts toward truth, accountability, and reconciliation will remain limited. The project’s capacity-building activities will engage both public and private lawyers to strengthen the national legal aid ecosystem and ensure inclusive access to justice for families of missing persons. Meanwhile families of missing persons continue to face daily legal and administrative challenges - from filing a disappearance report with the police to submitting DNA samples to the General Authority for the Search and Identification of Missing Persons, pursuing claimsfor compensation or requesting death certificatesUnder the supervision of UNDP Rule of Law Project Manager, the Transitional Justice Specialist, and in close collaboration with UNSMIL Human Rights team, and the international expert, the Contactor will provide capacity building to Libyan lawyers and support the establishment of a referral system providing legal aid services tofamilies of missing persons in Libya. The consultancy will strengthen the capacity of Libyan lawyers to provide quality legal aid and representation to families of missing persons. The assignment will also focus on establishing the foundations for a functional legal aid referral system, including through stakeholderconsultations, the drafting of a standard operating procedure (SOP), and piloting its application in coordination with local partners. This process will ensure inclusivity by engaging legal aid providers, civil society organizations, and relevant national institutions.The two trainings (in Tunis for private lawyers, and Tripoli for public lawyers) will enhance participants’understanding of the legal, institutional, and ethical dimensions of cases involving missing persons, and provide them with practical tools to: Advocate on behalf of families before national institutions and judicial authorities;Support families in navigating complex administrative and legal procedures; Promote accountability, truth, and reparations in line with international standards; and Strengthen trust between affected families and justice or forensic institutions.Following the trainings, participating lawyers are expected to provide legal assistance under the project framework, with support for related operational expenses. A trusted referral system will be developed with local civil society networks to ensure families’ access to trained legal support within their respective community inLibya..
Role objectives

In particular the consultant will be responsible for:

Technical Expertise on the Development of a Referral System for Legal Aid

Advising, in support of the international expert, on the establishment of a referral system

providing legal aid services to families.implementing consultations with key national counterparts, CSOs, and legal aid actors to design

a referral system providing legal aid services to families of missing persons, and support the international expert and project team in drafting a corresponding SOP that defines operational

roles, communication lines, and coordination mechanisms.

Providing technical guidance on the identification of local partners and needs assessment.

Capacity Building and Training

Designing and delivering contextually tailored training programs (including 2 trainings in-persons

in Tripoli and Tunis) targeting both public and private lawyers identified.

Topics include:

International Legal Frameworks

Obligations of Libya under international human rights and humanitarian law;

Role of international mechanisms in addressing enforced disappearances;

Comparative practices and lessons learned.

Practical use of international mechanisms and jurisprudence at the national level

National Legal and Institutional Frameworks

Definitions and categories of missing persons under Libyan law;

Mandates and roles of relevant national institutions;

National procedures from disappearance to identification

Administrative and judicial remedies available to families.

Victims’ Rights and Gender Dimensions

Legal status of the disappeared and implications for families;

Rights to truth, justice, and reparations;

Addressing gender-specific challenges faced by women relatives.

Practical Skills for Legal Aid and Case Management

Ethical standards and victim-centered approaches;

Drafting and filing key legal documents (complaints, judicial requests, …);

Trauma-sensitive interviewing and documentation techniques;

Handling sensitive information and data protection;

Coordinating with forensic and investigative authorities.

Transitional Justice

Understanding the link between missing persons, truth-seeking, and transitional

justice;

Role of lawyers in supporting MP and accountability efforts;

Coordination with national and international actors working on transitional justice and human rights documentation.

Safety, Security, and Professional Conduct Risk management and safety protocols for lawyers, witnesses and victims;

Confidentiality, digital security, and protection of witnesses.

Data collection:

Support the International Legal Aid Specialist in data collection and arrangement of meetings and

interviews with key partners during the consultation phase.

 

 

Project reporting

Our client's RoL team, with the international expert, will directly supervise the Contractor. The Contractor will support the international expert in developing the training modules, the tools for consultations, the SoP, and infacilitating the trainings. The Project Team will also receive the final report of the Consultant and evaluate the performance of the Contractor.

Key competencies

Minimum of 5 years of experience in working on enforced disappearances and/or transitional justice in Libya;

Minimum of 8 years of experience in practicing law in Libya, preferably human rights law;

Demonstrated knowledge of the Libyan legal framework especially with regards to enforced disappearances;

Experience in delivering trainings including for judicial actors.

 

Team management

the Contractor is expected to continuously liaise with the Project Team, and update them on progress, or any complications during the process. In coordination

with the international expert, the Contractor is also expected to liaise with the beneficiaries and asssit in identifying lawyers.

Further information

the consultant is expected to travel to Tunis to attend and support the facilitation of a training for lawyers.The travel should be for 4 days/3 nights. travel fees for any mission abroad or other locations in country, which include ticket will be also paid in

accordance with our clients rates where the applicable fees are based on the most economic, direct route. Business class tickets will not be considered, if the contracted individuals wish to buy business class ticket,the additional amount of the ticket will be covered by the contracted individuals
